Phillips Nizer Successfully Vacates Judgment, Preserving Estate Assets for Rightful Beneficiaries

Phillips Nizer safeguarded the integrity of a decedent’s estate by successfully vacating a confession of judgment entered by the decedent’s ex-husband.  If enforced, the judgment, which amounted to more than half a million dollars, would have unjustly diverted the entirety of the estate's assets away from the decedent’s intended beneficiaries.

Our dedicated legal team, led by associate Judith Swartz, prevailed with compelling arguments before the State Supreme Court (Rockland County) that the judgment was facially deficient and should never have been entered in the first place.  The Court vacated the confession of judgment, preventing the improper seizure of the estate's assets by the ex-husband.
